General Terms and Conditions of Sale (GTC)

1) Purpose and Scope

These General Terms and Conditions of Sale (GTC) govern:

  • the online booking of gîte-type accommodation offered on the maisondecharme-granville.com website (hereinafter the "Site");

  • the booking of additional services offered as an option (breakfast, bike rental, singing lessons, massage), hereinafter referred to as "Services".

Any order/booking placed on the Site implies the Client's (hereinafter the "Client") unreserved acceptance of these GTC.

3) Definitions

Accommodation: the gîte booked (Granville or Folligny) as described on the Site page. [1][2]
Booking: an order for Accommodation, for specified dates, and/or for Services.
Earnest Money Deposit / Down Payment: see §7.2 (choose qualification and apply everywhere). [3][4]

4) Service Characteristics

The essential characteristics of the Accommodation and Services (capacity, equipment, conditions, prices, etc.) are presented on the Site, in accordance with pre-contractual information obligations.

5) Availability

The availabilities displayed on the Site are updated regularly.
In case of exceptional unavailability after a booking request (e.g., technical problem, overbooking), maisondecharme-granville.com will contact the Client as soon as possible to propose:

  • an alternative solution (change of dates / other accommodation), or

  • cancellation and refund of sums already paid, as applicable.

6) Booking Process (Online Order)

6.1 Steps
The booking is made online following the process offered on the Site (choice of dates, options, contact details, payment, confirmation).

6.2 Confirmation
The Booking is considered confirmed when:

  • the required payment (total or partial according to §7) is validated, and

  • the Client receives a confirmation email.

6.3 "Order with Payment Obligation"
In accordance with the rules applicable to contracts concluded electronically, the validation of the order implies a payment obligation (button such as "order with payment obligation" or equivalent wording).

7) Prices – Taxes – Payment Terms

7.1 Prices
Prices are indicated in euros and include all taxes (TTC), and are visible before the booking is concluded.
Unless otherwise stated, the price includes:

  • the provision of the Accommodation for the booked period,

  • charges [to be specified: water/electricity/heating depending on season],

  • [linens / towels / end-of-stay cleaning: specify what is included or not].

Unless otherwise indicated, the following are not included:

  • tourist tax (if applicable),

  • cleaning fees (if optional),

  • options and additional Services.

7.2 Deposit upon booking: Earnest Money Deposit

Earnest Money Deposit:
Upon booking, the Client pays an earnest money deposit of 30% of the total amount. [3][5]
Reminder: in the absence of specific indication, sums paid in advance are presumed to be earnest money deposits.
The general rules on earnest money deposits (forfeiture / double refund as applicable) derive notably from Article 1590 of the Civil Code.

7.3 Balance
The balance is due:

  • 2 days before arrival or

  • upon arrival, depending on your arrangement.

In case of non-payment of the balance by the due date, maisondecharme-granville.com reserves the right to cancel the Booking and apply the cancellation conditions (§9).

7.4 Payment Methods
Accepted methods: Credit card via Stripe/Wix Payments (Google Pay, Apple Pay)

8) Security Deposit – Inventory / Condition Report

A security deposit of €200 may be requested before entry into the premises (bank pre-authorization, uncashed check, or other method).
It covers, in particular: damages, loss of keys, breaches of rules (abnormal overconsumption, unperformed cleaning if agreed, etc.).
Return of the security deposit: within 7 days after departure, after deduction of any sums due, with supporting documents where relevant.

9) Cancellation / Modification Conditions

9.1 Cancellation/Modification by the Client

More than 3 days before arrival: free cancellation
Between 2 and 3 days: 50% of the stay due
Less than 1 day / no-show: 100% due

9.2 Cancellation by the Seller
In case of cancellation attributable to maisondecharme-granville.com (excluding force majeure), the sums paid will be refunded [and/or] a replacement solution may be offered. [6][7]

9.3 Interruption of Stay
Any commenced stay is due, unless expressly agreed otherwise.

10) Additional Services (breakfast, bikes, classes, massage)

10.1 Booking
Services can be booked:

  • at the time of Booking, or

  • later (subject to availability).

10.2 Cancellation of Services
Free cancellation up to 24 hours before,
otherwise 50% due.

10.3 Services provided by a Partner

Scenario 1 — We sell the Service (we collect payment)
In this case, the Service is part of the contract between the Client and maisondecharme-granville.com. We are the main contact for after-sales service/complaints.

Scenario 2 — We are the intermediary (the partner collects payment)
If certain Services (e.g., massage) are performed and paid for by a third-party provider, then:

  • the service contract is concluded directly between the Client and the provider,

  • maisondecharme-granville.com acts only as an intermediary for referral and cannot be held responsible for the performance of the service by the third party (schedules, contraindications, etc.).

11) Internal Regulations – Use of Premises

The Client agrees to respect the following rules:

  • maximum capacity: 4 people;

  • respect for neighbors (no unauthorized parties/gatherings);

  • smoking prohibited: yes;

  • animals: refused;

  • cleanliness: cleaning included;

  • any damage must be reported without delay.

12) Liability

The Client is responsible for any damage caused by themselves or the people accompanying them.
The Client is advised to check that they have civil liability insurance covering holiday stays. [8][9]

The responsibility of maisondecharme-granville.com cannot be engaged in case of abnormal use, Client fault, or force majeure. [6][7]

13) Right of Withdrawal (Distance Selling)

In accordance with the Consumer Code, the right of withdrawal does not apply to accommodation services (other than residential) provided on a specific date or period, nor to certain leisure activities on a specific date. [10][11]
Consequently, Accommodation bookings made on the Site do not benefit from the right of withdrawal.

14) Personal Data
Personal data is processed in accordance with the Privacy Policy of the maisondecharme-granville.com Site.

15) Intellectual Property – Free PDF Guide

The free local PDF guide (available after registration) is protected by copyright.
Unless written authorization is obtained, it is forbidden to reproduce, resell, or publicly distribute it.

16) Complaints – Consumer Mediation

16.1 Prior Complaint
In case of difficulty, the Client is invited to contact the site administrator (contact form).

16.2 Mediation (mandatory in B2C)
In accordance with the Consumer Code, the consumer may have free recourse to a consumer mediator to attempt to resolve the dispute amicably, after a prior written approach to the professional. [12][13]

16.3 European Online Dispute Resolution (ODR) Platform
The European ODR platform was discontinued on July 20, 2025. [14][15]

17) Applicable Law – Competent Jurisdiction

These GTC are subject to French law.
In case of dispute, and in the absence of an amicable resolution / mediation, the competent courts will be determined according to the rules of common law.
